Velloria

Terms of Service

Last updated: November 4, 2026

IMPORTANT NOTICE: PLEASE READ CAREFULLY. These Terms contain a mandatory individual arbitration agreement (Section 21), a class action and jury trial waiver (Section 22), a one-year limitation period for claims (Section 26) and a limitation of our liability (Section 18). They affect your legal rights. You may opt out of arbitration within 30 days as described in Section 23.

Overview

This website and store (the "Site") is operated by Velloria ("Velloria", "we", "us", "our"). Throughout the Site, the terms "you" and "your" refer to every person who visits the Site, places an order, or otherwise uses our products, services, content, tools and offers (together, the "Services"). By visiting the Site, placing an order, or using the Services in any way, you agree to be bound by these Terms of Service (the "Terms"), our Privacy Policy, our Refund Policy, our Shipping Policy and our Refill Plan & Cancellation Policy, each of which is incorporated into these Terms by reference. If you do not agree to all of these Terms, do not use the Site or the Services.

Our store is hosted and our payments are processed by Whop, Inc. ("Whop"), which provides the online platform and payment processing that allow us to sell our products to you. Whop's own terms and privacy policy govern your use of its checkout and account tools.

1. Eligibility and Online Store Terms

By agreeing to these Terms you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use the Site. You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Services, violate any laws in your jurisdiction. You must not transmit any worms, viruses or any code of a destructive nature. A breach of any of the Terms results in an immediate termination of the Services.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including payment card information) may be transferred unencrypted and involve transmissions over various networks and changes to conform to technical requirements. Payment card information is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services without our express written permission.

3. Products, Pricing and Availability

Our products are available exclusively online through the Site and may have limited quantities. Prices are shown in the currency selected at checkout and are subject to change without notice. We reserve the right at any time to modify or discontinue any product, price, promotion or offer without notice. We have made every effort to display our products accurately, but we cannot guarantee that your screen's display of any colour, scent description or image will be accurate.

Our fragrances, personal-care and beauty products are cosmetic products for external use only. They are not intended to diagnose, treat, cure or prevent any disease, and nothing on the Site is medical advice. Patch test before first use, keep products away from the eyes, stop using a product if irritation occurs, and consult a healthcare professional before use if you are pregnant, nursing or have a skin or scalp condition. Fragrances contain alcohol and are flammable: keep them away from heat and open flame. Scent is personal and a fragrance's notes, longevity and projection vary with skin and conditions; individual results vary. Where a product is described as "inspired by" another fragrance, that name belongs to its owner and is used only to describe the scent profile; we are not affiliated with, sponsored by or endorsed by that brand, and our product is not a copy of it.

4. Orders, Billing and Account Information

We reserve the right to refuse or cancel any order you place with us, including orders that appear to be placed by dealers, resellers or distributors, orders that exceed per-person or per-household limits, and orders that our payment processor or fraud screens flag. You agree to provide current, complete and accurate purchase and account information for all purchases made on the Site and to promptly update your account, email address, payment card numbers and expiration dates so we can complete your transactions and contact you as needed. You represent that you are authorized to use the payment method you provide and that sufficient funds are available. If a payment is declined, we and our payment processor may retry it and may use card-network account-updater services to obtain updated card details.

5. Refill Plan (Automatic Renewal) Disclosure

Many of our products are sold on a refill plan. When the subscribe box at checkout is ticked, or an offer page says a refill plan is included, you expressly and affirmatively authorize us to automatically charge the payment method on file the recurring amount shown at checkout or on the offer page (plus the shipping fee shown, where one applies, and taxes where they apply) every 28 days, starting 28 days after your order, until you cancel. The recurring amount and its frequency are shown on the checkout page before you place your order and in your order confirmation email. Where a free gift offer includes a refill plan, the page states the refill price and its frequency before you accept it.

  • Cancel anytime, free of charge. Cancel by emailing support@shopvelloria.com with the name and email address used at purchase, or through the form on our Contact page. To avoid the next charge, cancel at least 24 hours before your next billing date. We confirm every cancellation by email within 1 business day. Cancellation stops future charges but does not refund charges already made, except as the Refund Policy provides.
  • It is your responsibility to monitor your renewal dates and cancel before a renewal if you do not want it. The 28-day cycle runs from the date of your order.
  • If a refill was charged before you cancelled, contact us within 14 days of that charge and we will refund it in full. Refill charges older than 14 days are not refundable.
  • You may skip a delivery, change the quantity or move your next billing date by emailing us; requests made at least 24 hours before the billing date apply to that cycle.
  • We may change the refill price or contents on notice to you by email at least 28 days before the change takes effect; you may cancel at any time before it does.
  • The 3-unit offers shown after checkout ("Add 1, get 2 FREE") are one-time charges, not subscriptions: each is charged once and never renews.

Full terms are in our Refill Plan & Cancellation Policy, which controls if it conflicts with this section.

6. Shipping and Taxes

Shipping charges and any applicable sales taxes are shown at checkout and are charged with your order. Shipping charges are non-refundable except where the Refund Policy says otherwise. Title and risk of loss pass to you when we hand the order to the carrier. Our Shipping Policy states delivery estimates; they are estimates only and we are not liable for carrier delays. You are responsible for providing a correct shipping address; we are not responsible for orders delivered to an incorrect address you supplied.

7. Refunds, Returns and the 60-Day Guarantee

Your first order is covered by our 60-day money-back guarantee as set out in our Refund Policy, which controls over this section: a refund of the product price may be requested within 60 days of the confirmed delivery date, no return shipment is required, the guarantee covers one order per customer, and shipping charges are non-refundable. Refund requests must be made within the windows the Refund Policy states; requests outside them are not eligible.

8. Chargebacks and Billing Disputes

If you believe a charge is wrong, contact us at support@shopvelloria.com first and within 30 days of the charge appearing on your statement so we can resolve it quickly; most billing questions are resolved within one business day, and refunds under our policies are faster than a card dispute. Nothing in this section waives any right you have under applicable consumer-protection law or your card issuer's chargeback procedures. If a charge is reversed by your bank for an order that was delivered and not refunded under our policies, we may invoice you for the amount, suspend or cancel any refill plan and refuse future orders.

9. Electronic Communications and SMS Messaging

By placing an order or providing your contact details, you consent to receive communications from us electronically, including order confirmations, shipping updates, refill reminders and customer-service messages, and you agree that all agreements, notices and disclosures we provide electronically satisfy any legal requirement that they be in writing.

SMS terms. If you opt in to text messages by entering your mobile number and agreeing to receive texts, you consent to receive recurring automated marketing and informational text messages (SMS and MMS) from or on behalf of Velloria at the number provided, including messages sent by an automatic telephone dialing system. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time and HELP for help. Carriers are not liable for delayed or undelivered messages. You represent that you are the account holder or authorized user of the mobile number and you agree to notify us at support@shopvelloria.com before the number is reassigned. Mobile information and text opt-in data will not be shared with third parties for their marketing purposes.

10. Third-Party Tools and Links

We may provide access to third-party tools (including Whop's checkout and account portal, carriers' tracking pages and payment methods) that we neither monitor nor control. Such tools are provided "as is" without warranties of any kind, and your use of them is at your own risk and subject to their providers' terms. Links on the Site may direct you to third-party websites that are not affiliated with us; we are not responsible for their content, accuracy or practices.

11. User Comments, Reviews and Submissions

If you send us reviews, comments, photos, suggestions or other materials ("Submissions"), you grant us a perpetual, irrevocable, royalty-free, worldwide licence to use, edit, copy, publish, translate and distribute them in any medium. You represent that your Submissions are your own, are accurate, do not violate any right of any third party and do not contain unlawful, abusive or obscene material. We may, but have no obligation to, monitor, edit or remove Submissions.

12. Personal Information

Your submission of personal information through the Site is governed by our Privacy Policy.

13. Errors, Inaccuracies and Omissions

Occasionally there may be information on the Site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any errors, to change or update information, and to cancel orders if any information is inaccurate at any time without prior notice, including after you have submitted your order.

14. Prohibited Uses

You are prohibited from using the Site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in unlawful acts; (c) to violate any regulation, rule or law; (d) to infringe our or others' intellectual property rights; (e) to harass, abuse, defame or discriminate; (f) to submit false or misleading information, including false claims to obtain refunds, replacements or chargebacks; (g) to upload viruses or malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Site. We reserve the right to terminate your use of the Services for violating any of the prohibited uses.

15. Intellectual Property

The Site and all of its content, including text, graphics, logos, product names, images, videos and software, are owned by or licensed to Velloria and are protected by copyright, trademark and other laws. You may not use our names, logos or content without our prior written consent. Third-party brand and fragrance names that appear on the Site belong to their owners and are used only for comparison.

16. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT ANY RESULT WILL BE OBTAINED FROM USING OUR PRODUCTS. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

17. Indemnification

You agree to indemnify, defend and hold harmless Velloria and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, your violation of any law or the rights of a third party, or your Submissions.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL VELLORIA, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, INTERNS, SUPPLIERS, SERVICE PROVIDERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS, EVEN IF ADVISED OF THEIR POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS BEFORE THE EVENT, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). These limitations do not apply to liability for fraud, gross negligence or wilful misconduct, or to any liability that cannot be limited by applicable law. Some states (including New Jersey) do not allow some of these limitations; in those states our liability is limited to the maximum extent permitted by law.

19. Termination

These Terms are effective unless and until terminated by either you or us. You may terminate them at any time by notifying us that you no longer wish to use the Services and by cancelling any refill plan. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term of these Terms, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. Sections 5, 8, 11 and 15 through 30 survive termination.

20. Mandatory Pre-Arbitration Notice and Informal Resolution

Most concerns can be resolved quickly by emailing support@shopvelloria.com. Before either party starts an arbitration or any other proceeding, the party must send the other a written Notice of Dispute. You send yours to support@shopvelloria.com with the subject line "Notice of Dispute"; we send ours to the email address on your order. The notice must include your full name, the email used for your order, the order number(s), a detailed description of the dispute and the relief you seek, and must be personally signed by you (an email from your own address with your typed name counts). The parties will then try in good faith to resolve the dispute for 60 days from receipt of the notice (extendable by written agreement). Compliance with this section is a condition precedent to starting an arbitration or any court proceeding, and any limitation period is tolled during the 60-day period.

21. Mandatory Individual Arbitration Agreement

You and Velloria agree that any dispute, claim or controversy arising out of or relating in any way to the Site, the Services, any product, any purchase, any refill plan, any advertising or marketing, our Privacy Policy or these Terms, including their interpretation, applicability, enforceability or formation (together, "Disputes"), shall be resolved exclusively by final and binding individual arbitration and not in court, except as stated in this section. This agreement is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16.

  • Administrator and rules. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, as modified by these Terms, before a single neutral arbitrator. The rules are available at www.adr.org. If the AAA is unavailable or declines to administer the arbitration, the parties will select another nationally recognised consumer arbitration provider, or a court of competent jurisdiction will appoint one.
  • Delegation. The arbitrator, and not any court, has exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability or formation of this arbitration agreement, including any claim that all or part of it is void, voidable or unconscionable, except that a court decides the enforceability of the class action waiver in Section 22.
  • Seat and hearings. The seat of arbitration is Sheridan County, Wyoming. Hearings will be held by video conference or telephone where possible; if an in-person hearing is required, it will be held in the county where you live, and you will not be required to travel to Wyoming.
  • Fees. Payment of filing, administration and arbitrator fees is governed by the AAA rules. If the arbitrator finds that you cannot afford your share of the fees and no fee waiver is available, we will pay any fees above the equivalent court filing fee. Each party bears its own attorneys' fees and costs unless applicable law or the arbitrator awards them to the prevailing party, and the arbitrator may award attorneys' fees and costs against a party whose claim or defence is frivolous or brought for an improper purpose.
  • Decision. The arbitrator shall issue a reasoned written decision, may award the same individual relief that a court could award, and shall apply the substantive law of Wyoming consistent with the FAA. Judgment on the award may be entered in any court of competent jurisdiction. The arbitration and its outcome are confidential except as needed to enforce the award.
  • Exceptions. Either party may bring an individual claim in small claims court if it qualifies and remains there, and either party may seek injunctive or equitable relief in court to protect its intellectual property.

22. Class Action and Jury Trial Waiver

YOU AND VELLORIA EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO BRING, JOIN OR PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL OR REPRESENTATIVE PROCEEDING, WHETHER IN ARBITRATION OR IN COURT. The arbitrator may award relief only to the individual party seeking it and only to the extent necessary to provide relief warranted by that party's individual claim, and may not consolidate more than one person's claims except as Section 24 provides. If this class action waiver is found unenforceable as to a particular claim or request for relief, then that claim or request (and only that claim or request) shall be severed from the arbitration and brought in the state or federal courts located in Wyoming, and it shall be stayed pending the outcome of any individual arbitration. Class-wide settlements remain permitted.

23. 30-Day Right to Opt Out of Arbitration

You may opt out of the arbitration agreement in Section 21 and the class action waiver in Section 22 by emailing support@shopvelloria.com with the subject line "Arbitration Opt-Out" within 30 days after the earliest of: your first purchase from the Site, your first use of the Site, or your first acceptance of these Terms. Your opt-out notice must include your full legal name, the email address and mailing address used for your order, your order number(s), and a clear statement that you wish to opt out of arbitration. Each notice opts out one person only. An opt-out received after the 30-day window is not effective. Opting out does not affect any other provision of these Terms, including the limitation period and the limitation of liability.

24. Mass Arbitration Procedures

If 20 or more similar arbitration demands are brought by or with the assistance of the same law firm, group of law firms or organisation, the parties agree that the demands will be administered in batches of no more than 20 demands each (and any remainder), with one arbitrator appointed per batch and a single set of filing and administrative fees per side per batch. The parties will cooperate in good faith with the administrator to implement this batching, and a court may enforce it. This section does not authorise class arbitration. Any dispute about whether this section applies will be decided by a process arbitrator appointed by the administrator before any individual arbitrator is appointed.

25. Public Injunctive Relief

To the extent permitted by law, you waive any right to seek public injunctive relief. Where that waiver is not permitted, any claim for public injunctive relief will be decided by the arbitrator after the individual claims are resolved, or by a court if binding law so requires, and all other claims remain in individual arbitration.

26. Limitation Period

To the extent permitted by law, any claim or cause of action arising out of or relating to the Services, any product, any purchase or these Terms must be filed within one (1) year after the cause of action accrues, or it is permanently barred.

27. Governing Law; Venue for Non-Arbitrable Disputes

These Terms and any Dispute are governed by the laws of the State of Wyoming and the Federal Arbitration Act, without regard to conflict-of-law rules. Where a Dispute is not subject to arbitration (including after a valid opt-out), you and we agree to the exclusive jurisdiction and venue of the state and federal courts located in Wyoming, and you consent to personal jurisdiction there. Nothing in this section deprives you of the protection of mandatory consumer-protection laws of the state or country where you live that cannot be waived by agreement.

28. Changes to These Terms

We may update these Terms at any time by posting the revised Terms on the Site and updating the "Last updated" date. Material changes to Sections 20 through 27 will not apply to a Dispute of which we had notice before the change. Your continued use of the Site or the Services after a change is posted constitutes acceptance of the change; if you do not agree, stop using the Services and cancel any refill plan. You may reject a material change to the arbitration sections by emailing support@shopvelloria.com within 30 days of its posting, in which case the previous arbitration agreement continues to apply to you.

29. Entire Agreement; Severability; Waiver; Assignment

These Terms, together with the policies they incorporate, constitute the entire agreement between you and us regarding the Services and supersede any prior agreements. If any provision is found unlawful, void or unenforceable, it shall be enforced to the fullest extent permitted by law and severed, and the remaining provisions remain in full force, subject to the severance rule in Section 22. Our failure to enforce any right or provision is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or a successor. Section headings are for convenience only. These Terms do not create any third-party beneficiary rights.

30. Notice for California Residents

Under California Civil Code § 1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. California residents on a refill plan may cancel it at any time by emailing support@shopvelloria.com or through the form on our Contact page; we confirm every cancellation by email within 1 business day.

31. Contact Information

Questions about these Terms, Notices of Dispute, arbitration opt-outs and all other legal notices should be sent by email to support@shopvelloria.com. Velloria is a United States company.
